What is a Freedom of Information Act (FOIA) Request?

  • A FOIA request is a written request to inspect and copy the public records of the Brandywine School District.  Public records are any written or recorded information produced or compiled by the District that relate to its operations and purpose. Public records do not include personnel and student records; that information is protected by law from public access.

See The Delaware Freedom of Information Act , 29 Del. C. Chapter 100 and Board of Education Policy 02.7.

All requests will be processed by the District’s FOIA Coordinator.  The Coordinator for BSD is Superintendent Dr. Mark Holodick. If you choose not to use the online form provided here be sure that your written request includes your contact information. Make sure it identifies the specific records you wish to view as completely as possible.

What information must my FOIA request include?

Your request should be as specific as possible. It should describe the information you are looking for so that District can locate the records. After receiving your request, the FOIA Coordinator may contact you to ask for additional information. If those records are not here at the district but in the control of another public body, the FOIA Coordinator will forward your request to that public body and notify you that your request has been forwarded.

What happens when I submit my FOIA request?

The District will notify you within 15 business days of receiving your request as to whether the records are available or if the District needs more time to locate the records.  If the records are available, you will be asked to schedule an appointment to review the information at the District's Administrative Offices.  Appointments will be made between 8:00 AM and 4:00 PM, Monday through Friday. If your appointment is in the afternoon, please allow time to inspect the record before the office closes at 4:00 pm. All requests are processed by the District in the order they are received.

FOIA does not require the District to prepare summaries or reports of records in response to a FOIA request. In some circumstances records may be quite large and include many pages.

Is there a cost associated with a FOIA request?

The first 20 standard sized pages are provided free of charge.  After that, copies are $0.10 per printed page ($0.20 for two sided pages). Other charges may apply.
